Welcome to W9A Properties. These Terms and Conditions apply to the use of our website and online booking pages at https://162628_1.holidayfuture.com and to any booking you make with us.
By using this website and/or making a booking, you agree to these Terms and Conditions. If you do not agree, please do not use the website.
“Guest”, “Client”, “you” and “your” refer to the person using the website and/or making a booking. “We”, “us”, “our” and “W9A Properties” refer to our business. “Property” refers to the accommodation you have booked.
These Terms are governed by the laws of Scotland.
BOOKINGS
1.1 A booking is only confirmed when you receive a written confirmation email from us or from our booking provider (Hostaway) on our behalf.
1.2 By making a booking, you confirm that you are at least 18 years old and authorised to act on behalf of all guests.
1.3 You must provide accurate and complete information when making a booking.
PRICES, PAYMENTS AND DEPOSITS
2.1 The price for your stay will be shown at the time of booking.
2.2 A deposit and/or full payment is required as stated during the booking process to secure your reservation.
2.3 We may require a refundable damage/security deposit. Details will be shown during booking and/or in your confirmation.
2.4 If you fail to pay when due, we may cancel your booking.
CANCELLATIONS AND CHANGES
3.1 Our cancellation policy is displayed during booking and forms part of these Terms.
3.2 If you cancel within a non-refundable period, you may lose all or part of your payment.
3.3 If we must cancel due to circumstances beyond our reasonable control (for example serious maintenance or safety issues), we will offer an alternative date where possible or a refund of amounts paid. Our liability is limited to the amount paid for that booking.
USE OF THE PROPERTY
By staying at the Property, you agree that:
4.1 The Property is used for holiday/short-term stay purposes only and not as your main residence.
4.2 You will not exceed the maximum occupancy stated in the listing.
4.3 No parties or events are permitted without our prior written consent.
4.4 No smoking is allowed inside the Property.
4.5 You will respect neighbours and keep noise to a reasonable level, especially during quiet hours.
4.6 You will follow all house rules provided in the listing, welcome guide or at the Property, and leave the Property in a reasonably clean and tidy condition.
We reserve the right to end your stay without refund if you seriously breach these rules or behave in a way that causes damage, disturbance or risk to others.
DAMAGE, LOSS AND ADDITIONAL CHARGES
5.1 You are responsible for any damage to the Property, its contents or common areas caused by you or your party.
5.2 We may charge for repairs, replacement items or excessive cleaning, and deduct these from your security deposit (if taken) or invoice you directly.
5.3 Please report any damage or issues as soon as possible during your stay.
CHECK-IN AND CHECK-OUT
6.1 Standard check-in and check-out times are stated in your confirmation and/or listing.
6.2 Early check-in or late check-out may be available by prior agreement and may incur an additional charge.
6.3 Failure to depart on time without agreement may result in extra charges.
WEBSITE USE
7.1 We aim to keep all information on our website accurate and up to date, but details, photographs and descriptions are for general guidance only and may change over time.
7.2 We are not responsible for temporary unavailability of the website due to technical issues beyond our control.
LIABILITY
8.1 We do not exclude or limit any liability that cannot be excluded by law (including for death or personal injury caused by our negligence).
8.2 Subject to this, our total liability to you in connection with your booking and stay will not exceed the total amount paid by you for that booking.
8.3 We are not liable for:
Loss or damage to your personal belongings;
Any indirect or consequential loss;
Events outside our reasonable control (for example weather, transport disruption, local works, utility failures not caused by us).
PRIVACY
9.1 Your use of our website and booking system is also governed by our Privacy Policy, which explains how we collect and use your personal data.
